A lawyer has vowed to pursue possible legal action over alleged paternity fraud after a DNA report established that his client was not the biological father of a child he had supported for about seven years.
Lawyer Shadrack Wambui told the court that his client was devastated by the findings, having invested in the minor’s upbringing and education under the belief that he was the child’s biological father.
“The conclusion is that xxxxxx is excluded as the biological father to the child,” the court was told as the findings of a DNA report dated August 12, 2026, were read out.
Reacting to the results, Wambui said his client was dissatisfied with the outcome and would consider further legal action against the respondent over what he described as paternity fraud.
“My client has been a victim of paternity fraud for the last about seven years and counting,” Wambui told the court.
The lawyer said his client would be advised on the appropriate legal steps to take following the findings.
However, Wambui applied to have the ongoing proceedings withdrawn in light of the DNA results. He also requested a copy of the report to enable his client to understand his legal position regarding the minor.
“We will be applying with humility that these proceedings be marked as withdrawn. Further, we will be praying that you furnish us with a copy of that DNA report so that we can serve it upon our client, who will be guided factually as to his legal status,” he said.
Wambui expressed regret over the time spent pursuing the matter, noting that the proceedings had taken approximately two years.
“We have educated this child, Your Honour. We have given him everything,” he said, highlighting his client’s disappointment over the findings.
Despite the outcome, the lawyer thanked the court for its assistance in handling the dispute.
The case had centred on determining the biological paternity of the minor. The DNA findings ruled out the man as the child’s biological father, prompting the withdrawal request and the lawyer’s declaration that further legal action could follow.
