A 32-year-old man has been charged before a Mombasa court with allegedly defiling an 11-year-old boy in Kizingo, Mvita Sub-County.

Nabil Farid Swaleh was arraigned before Senior Resident Magistrate Gladys Olimo, where he faced a charge of defilement contrary to Section 8(1), as read with Section 8(3), of the Sexual Offences Act No. 3 of 2006.

The court heard that the alleged offence occurred on October 21, 2026, in the Kizingo area of Mombasa County, where Swaleh is accused of intentionally and unlawfully defiling the minor.

He also faces an alternative charge of committing an indecent act with a child, contrary to Section 11(1) of the Sexual Offences Act.

According to the alternative charge, Swaleh allegedly touched the minor’s private parts on the same date and at the same location.

The accused pleaded not guilty to both charges.

Following the plea, Assistant Director of Public Prosecutions Brenda Ogada opposed his release on bond, asking the court to order a pre-bail report before determining his application.

Ogada told the court that there was significant public anger directed at the accused and urged the magistrate to consider the seriousness of the allegations and the safety of the minor when deciding on his release.

In response, Magistrate Olimo directed that Swaleh remain in police custody pending the determination of his bond application.

The court is scheduled to deliver its ruling on the application on October 26, 2026.

Swaleh remains presumed innocent unless and until proven guilty by a court of law.
