A Nairobi court has declined to review bail for a manyoka stunt matatu driver accused of causing a crash that killed three passengers and injured others along Enterprise Road in June 2026.
Magistrate Paul Mutai ruled that Sammy Murigi Maina will remain in custody until key prosecution witnesses testify, citing compelling reasons to deny him bail at this stage of the proceedings.
The court noted the slow pace of the trial, with only one witness appearing for the hearing on Wednesday. However, the magistrate said the delay should not prejudice the proceedings.
The prosecution was directed to produce eyewitnesses and investigate allegations that the investigating officer was frustrating the hearings.
The victims had raised concerns over the officer’s conduct, prompting calls for the officer to appear in court and respond to the allegations.
In his application, Maina’s defence argued that the accused was suffering in custody and sought a review of the bail decision. However, Mutai said he was not persuaded to vary the existing orders.
The case is scheduled to resume on November 9, when the prosecution is expected to call more witnesses.
Maina was arrested nearly two months after the June 3, 2026 crash and subsequently appeared in court to face multiple traffic-related charges.
He faces three counts of causing death by dangerous driving, contrary to Section 46 of the Traffic Act, Cap 403 of the Laws of Kenya.
The prosecution alleges that Maina was driving an Isuzu minibus, registration number KDU 887C, operated by Risen Sacco, along Enterprise Road near KCB Bank at around 8pm when the crash occurred.
