The High Court has cleared the proposed Sh154.2 billion upgrade of Jomo Kenyatta International Airport (JKIA) to proceed, while ordering the disclosure of the contract details surrounding the major aviation infrastructure project.
The ruling marks a significant development in the planned modernisation of Kenya’s busiest airport, which serves as the country’s main international aviation gateway and a critical hub for regional and global air transport.
However, the court’s directive requiring disclosure of the contract underscores the need for transparency and accountability in the implementation of major public infrastructure projects.
The Sh154.2 billion upgrade is expected to play a key role in improving airport facilities and strengthening JKIA’s capacity to handle growing passenger and cargo traffic.
The decision comes amid public scrutiny over the project’s financing, procurement arrangements and contractual terms, with transparency remaining central to discussions surrounding large-scale government investments.
Disclosure of the contract is expected to provide greater clarity on the obligations of the parties involved, the project’s implementation framework and the terms governing the proposed upgrade.
The court’s decision allows the project to move forward, subject to the applicable legal and contractual requirements, while requiring greater openness regarding the agreement.
The key question now is how the project will be implemented and whether the required contract disclosure will address concerns over transparency and public accountability.
