The Milimani Chief Magistrate’s Court has rejected a renewed bail application by Chinese national Chen Guang, alias Alex, for the second time as he awaits extradition proceedings to Uganda, where he is wanted to face 31 criminal charges.
The Director of Public Prosecutions (DPP), through the Office of the Director of Public Prosecutions (ODPP), successfully opposed Chen’s release, arguing that the circumstances that previously informed the court’s decision to deny him bail had not changed.
Chen is wanted in Uganda to answer to 30 counts of forgery and one count of theft.
In opposing the application, the prosecution raised concerns over Chen’s residential ties to Kenya, pointing to his short-term tenancy agreement as insufficient evidence of an established residence that would guarantee his availability throughout the extradition process.
The prosecution further argued that Chen’s lack of ordinary residence in Kenya, coupled with his extensive international mobility, presented a real and substantial risk that he could abscond if released on bail.
The DPP also challenged the proposed bail conditions, including surrendering his passport, reporting periodically to a police station and providing sureties, maintaining that the measures would not adequately mitigate the identified flight risk.
The prosecution, led by Senior Assistant Director of Public Prosecutions Duncan Ondimu, OGW, and Prosecution Counsel Fatma Shaban, urged the court to allow the extradition proceedings to proceed expeditiously while Chen remains in custody.
The prosecution maintained that continued detention was necessary to safeguard the extradition process and ensure Chen remains available to attend court proceedings.
The matter is scheduled for mention on November 4, 2026, at 3:00 p.m., when the court is expected to issue further directions.
The case remains pending as the extradition proceedings continue.
