The court has rejected an application by the Office of the Director of Public Prosecutions (ODPP) to detain two suspects for 30 days as investigations continue into the murder of Dr Victoria Nthunya Mutiso.

PC Collins Bett and Pius Muiru Mbugua, alias “Headboy”, are facing a murder charge under Section 203 as read with Section 204 of the Penal Code.

According to the charge sheet, the prosecution alleges that the two men, together with others who have not been brought before the court, murdered Dr Mutiso on July 29, 2026.

The alleged incident took place at about 9:30am along Mawensi Road in Kilimani, Nairobi County.

Prosecutors had asked the court for additional time to complete investigations, including having the two suspects undergo mental assessments.

The request for 30 days was opposed, with the court finding the proposed period unreasonable.

Justice Alexander Muteti instead directed that the suspects be taken for mental assessment within the period ordered by the court.

The judge also indicated that the two could be taken to a remand facility, noting the need for equality and to avoid complaints over their detention arrangements.

The suspects’ mental assessment is expected to inform the next stage of the proceedings.

The matter will be mentioned alongside the related case for plea taking once the assessment has been completed.

The murder allegations against Bett and Mbugua have not been proven in court, and they remain entitled to the presumption of innocence as the case proceeds.
