A Kibera Law Court has deferred the plea-taking of a man accused of cyber harassment over a message allegedly sent to a magistrate, following an application by the prosecution to have the case transferred to the Milimani Law Courts.

The prosecution asked the court to defer the plea and transfer the case to Milimani, arguing that the matter should be handled at another court. The defence opposed the application.

In its ruling, the Kibera court said it was of the considered view that proceeding with the case at Kibera could raise allegations of bias, given the circumstances surrounding the complaint.

The court, however, noted that any issues concerning alleged violations of the accused person’s rights could be raised and addressed once he takes plea.

The accused, Francis Kamau Karanja, was consequently ordered to remain in custody and appear before Milimani Law Courts Court 1 on Thursday for plea-taking.

Karanja faces a charge of cyber harassment contrary to Section 27(1)(a), as read with Section 27(2), of the Computer Misuse and Cybercrimes Act.

According to the charge sheet, Karanja allegedly sent a message on September 28, 2026, to a mobile phone number registered in the name of Magistrate Margaret Murage.

The prosecution alleges that the message, which made reference to the handling of a case involving Gabriel Saka, contained words likely to cause apprehension or fear of violence to the magistrate.

The matter will now come before the Milimani court on Thursday, where Karanja is expected to take plea and the case will formally proceed.
