A Nyamira man has been sentenced to 15 years in prison for murdering his wife in April 2024, following a successful prosecution by the Office of the Director of Public Prosecutions (ODPP).
Lawrence Gesore Sagero was sentenced by Nyamira High Court Judge T. Cherere after being found guilty of murdering Nancy Mongina in Borioba Village, Borangi Location, Nyamira North Sub-County.
The court heard that the offence occurred on April 18, 2024, at around 9am.
Sagero had denied the murder charge, prompting the prosecution, led by Deputy Director of Public Prosecutions Joel Kibet Chirchir, to present evidence to prove the case beyond reasonable doubt.
The prosecution called six witnesses whose testimonies linked Sagero to the killing.
A doctor who conducted the post-mortem examination testified that Mongina died from severe head injuries caused by blunt force trauma.
The court found that the evidence, including the medical findings, established the elements of murder and demonstrated malice aforethought.
In determining the sentence, Justice Cherere considered the seriousness of the offence alongside the mitigating circumstances presented before the court.
“Having balanced the gravity of the offending conduct against the mitigating circumstances, the Court considers that a substantial custodial sentence is warranted, but that the mitigation justifies a sentence below the maximum prescribed by law,” the judge ruled.
The court consequently sentenced Sagero to 15 years’ imprisonment.
The convict has 14 days within which to appeal the sentence.
