The Director General of the National Transport and Safety Authority (NTSA) has been summoned by the Transport Licensing Appeals Board Tribunal to explain the Authority’s failure to comply with orders lifting the suspension of Embakasi Shuttle Services Limited.

The Director General is expected to appear before the Tribunal on Monday, November 9, 2026, at 3:00 p.m., to account for the continued closure of the company’s portal despite orders issued on October 16, 2026, directing the lifting of the suspension.

During proceedings on Wednesday, November 4, Embakasi Shuttle’s lawyer told the Tribunal that NTSA had failed to reopen the company’s portal despite the earlier directives, leaving the transport operator unable to resume normal operations.

The lawyer argued that the company continued to suffer losses as a result of the portal remaining inaccessible and urged the Tribunal to intervene, insisting that its orders should not be disregarded.

However, a lawyer representing NTSA told the Tribunal that he had only recently been informed about the matter and was unaware that another advocate was already on record.

He sought additional time to respond to the application. On the issue of reopening the portal, the NTSA representative stated that the Authority would only proceed if the relevant department allowed or agreed to do so.

In its ruling, the Tribunal observed that NTSA had previously been represented by another lawyer when the matter came up on October 26, 2026.

It further noted that despite acknowledging service of the pleadings and court orders, the Authority had neither filed a response nor complied with the directives issued on October 16.

The Tribunal declined to allow the entire application at that stage, noting that the matter had been listed for directions.

However, it granted the request to summon the NTSA Director General, observing that the failure to comply with the orders was self-evident and had also been acknowledged by the Authority’s representative, Mr. Mwaniki.”No valid reason has been furnished, nor can there be any legal justification for disobedience of lawful orders.

Flouting of court orders undermines the proper administration of justice and risks anarchy,” the Tribunal ruled.

The summons now requires the NTSA Director General to personally explain the Authority’s continued failure to implement the October 16 orders.

The Tribunal is also expected to issue further directions on the disposal of the pending application and the substantive appeal when the matter resumes on November 9, 2026.

The ruling was delivered in Nairobi on November 4, 2026.
