Hearing continues today in the murder case against Sarah Wairimu Kamotho, who is accused of killing her late husband, Tob Cohen, with the prosecution expected to present further evidence before the High Court in Kibera.

The case is being heard before Lady Justice Diana Kavedza, with the prosecution having called four witnesses who testified on Cohen’s movements and interactions shortly before his disappearance.

The 13th prosecution witness, former Chamber of Commerce chairman Davis Njuguna Kamau, told the court about his interactions with Wairimu and events at the couple’s Lower Kabete residence on July 19, 2019.

Kamau said Wairimu had previously spoken to him about marital problems and alleged that Cohen was abusive.

He told the court that he and his friend Peter Karanja later went to the residence after Karanja received a distress call from Wairimu, who said she was facing domestic challenges and that police officers were at the house to harass her.

At the gate, they encountered four men in civilian clothes who identified themselves as police officers from Spring Valley Police Station.

Kamau said Cohen later emerged from the house, questioned their presence and made a telephone call regarding people he said were claiming to be police officers in his compound before driving away.

The prosecution also presented evidence on Cohen’s movements later that day.

Denis Gekona, who was the Chief Security Officer at Muthaiga Golf Club, identified records showing Cohen’s presence and activities at the club on July 19, 2019. However, he said the records did not establish the exact time Cohen left the club.

The court also heard from former Plums Hotel waiter Michael Wainaina Karuthai, who said he served Cohen at the hotel that night before he was joined by Margaret Wanjiru and two other women.

Karuthai testified that Cohen left the hotel at about 1:30 a.m., marking the last time he saw him.

Another witness, former Plums Hotel bartender Aggrey Ingano Muhalamu, also recalled serving Cohen and said he settled his bill following a minor altercation between him and Wanjiru.

The witness said Wanjiru was prevented from leaving with Cohen, who eventually left the hotel between 1:30 a.m. and 2:00 a.m. and appeared jovial at the time.

The prosecution is expected to call additional witnesses as it continues presenting its case.
