The Court of Appeal has declined the Government’s application to stay High Court orders declaring the Safaricom PLC shares sale transaction null and void, according to a statement issued by Wiper Patriotic Front leader Kalonzo Musyoka on Tuesday, October 13, 2026.
Kalonzo, who attended the virtual court proceedings from London, United Kingdom, was representing petitioners led by Tony Gachoka and others in the case.
The appeal was heard by Justices Kimaru, Okello and M’Inoti, who declined the Government’s request to suspend the High Court orders issued on September 15, 2026.
The High Court had declared the transaction null and void, with the latest decision leaving those orders in place.
In his statement, Kalonzo reiterated that national assets belong to the people of Kenya and must be managed in accordance with the Constitution and the rule of law, rather than the interests of those in power.
Beyond the court proceedings, Kalonzo is in the United Kingdom for a series of engagements focused on business and governance.
He delivered a keynote address at the House of Commons to the Westminster Africa Business Group, in partnership with the Eastern Africa Association.
He was also scheduled to address Chatham House on the topic, “The Opposition’s Outlook and Policy Agenda on the Road to the 10 August 2027 General Election.”
The address was expected to focus on constitutionalism, accountable leadership, economic justice and the protection of national interests.
Kalonzo serves as party leader of the Wiper Patriotic Front and The Ukamboti Alliance, as well as principal of The United Alternative Government.
The Safaricom shares sale case remains a significant legal and public interest matter, with the dispute raising questions about the management of public assets and the legal framework governing major transactions involving national interests.
