A woman has been charged before a Mombasa court over an alleged land fraud involving two parcels of property valued at KSh100 million in Likoni, Mombasa County.
Farzana Nur Butt appeared before Senior Resident Magistrate Gladys Olimo, where she denied three charges relating to the alleged fraudulent acquisition and registration of land belonging to Susan Wanjiru Kangethe.
In the first count, Butt was charged with conspiracy to defraud, contrary to Section 317 of the Penal Code. She is accused of conspiring with others who were not before the court to defraud Kangethe of parcels identified as Mombasa/MS/Block 1/1944 and Mombasa/MS/Block 1/1945.
The alleged offence is said to have occurred between July 12, 2006, and October 20, 2026, within the Coast region.
The court heard that the two parcels, registered at the Mombasa Land Registry, were allegedly claimed without the registered owner’s authority.
Butt is also accused of causing the registration of the land in the names of her relatives, Jamshed Ahmed Butt and Fahmeda Begum Butt, using information she allegedly knew to be false.
In the second count, she was charged with obtaining registration of land by false pretences, contrary to Section 320 of the Penal Code. The prosecution alleges that she inserted Title Lease No. Mombasa/MS/Block 1/416 into the land records on July 12, 2006, with the intention of depriving Kangethe of the property.
The third charge is forcible entry, contrary to Section 90 of the Penal Code. Butt is accused of unlawfully entering the premises at Shelly Beach, Likoni, between July 9, 2025, and October 20, 2026, with the intention of annoying the registered owner.
Butt denied all three charges and, through her lawyer, asked the court to release her on reasonable bond terms, saying she had a fixed residence within the court’s jurisdiction.
Assistant Director of Public Prosecutions Breda Ogada urged the court to set bond terms appropriate to the charges.
Magistrate Olimo granted Butt a bond of KSh1 million with a surety of a similar amount.
The court scheduled the pre-trial conference for November 12, 2026.
